During any creation of firm or statement of activity, the businessman whose occupation consists of commercial acts must register in the register of trade and of societies (RCS), that it is as natural or artificial person (society or business firm, SARL, public company, impersonal firm with limited liability - EURL - grouping of economic interest). The voluntary absence of registration in RCS is considered to be an offence of secretive job.
The justification of registration in RCS is made by the presentation of a document, which can be issued only by the Офис of the Clerk of the Court of the court dealing with trade disputes: extract K for the individuals or extracts it K greyish for the legal entities.
The extract, which gives information about the activity of the firm and the identity of the leaders, administrators and auditors, constitutes the only lawful and official document certifying the legal existence of a commercial company. It regroups all the mention carried to RCS and takes back all decisions of the court dealing with trade disputes in collective procedures (procedures of maintenance, rebounds and compulsory liquidations).
In most cases, to be opposable and to make faith for administrative steps, extract must date from less than 3 months.
It is possible to get online, for payment, an extract K or KBIS for a firm registered in France to transplants of the courts of trade. Request can be made either by registered company name, acronym or name of the firm, or by its number Siren.
Some information is free given: number RCS, address of the head Офис, encodes NAF activity, legal form of the firm, dates from its registration.
ATTENTION! If you cannot move or if you do not have Internet, our Centre of Formalities of Firms (CFE) performs online request in your place. It will be invoiced to you only the benefit paid in Transplants of the Court dealing with trade disputes.
