A decree of May 17th, 2006 had generalised in all establishments accepting from public (ERP) the obligation of accessibility of their places to the handicapped persons. This obligation will have to be respected as from January 1st, 2015 in existent ERP.
However, the deliverance of a licence to construct concerning a permission of jobs or of creation of ERP is subordinated from now on to the realisation of developments necessary for this accessibility. The respect for this obligation will be able to be proved on production of a confirmation of compliance.
This one will be able to be issued only by an organism of tenured MOT of a ministerial amenity or an architect (other than that having signed the request of licence to construct). The master of work will have to transmit the certificate in 30 next days jobs to the administrative authority having issued the licence to construct and to the concerned mayor. An order specifies contents and conditions of deliverance of this certificate a model of which is introduced in annex.
